These Terms and Conditions (“Terms”) govern the use of this website and all charter inquiries, bookings, and services provided by Ascente Yacht Charters (“Ascente,” “we,” “us,” or “our”). By accessing this website or engaging our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use this website or our services.

1. About Ascente Yacht Charters

Ascente Yacht Charters provides luxury bareboat yacht charters in Alaska, British Columbia, and Washington State.

Additional operational details, and vessel specifications are available upon request.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use this website or enter into a charter agreement.

3. Nature of Bareboat Charters

All charters offered are bareboat (demise) charters unless otherwise expressly stated.

Under a bareboat charter:

  • Possession and control of the vessel transfers to the Charterer for the charter period
  • The Charterer assumes responsibility for operation, navigation, and management of the vessel
  • Captain, crew, and vessel services during the Charter are arranged by the Charterer separately with a third party service provider. Any such captain, crew, and service providers shall be engaged by, and act on behalf of, the Charterer and not the Owner.


All bookings are governed by a Recreational Bareboat Charter Agreement.

Additional special conditions may apply and are available upon request.

4. Inquiries and Quotations

All inquiries submitted through this website are requests for information only and do not constitute a binding reservation.

  • Rates and applicable taxes vary by jurisdiction
  • Pricing is subject to change without notice
  • Prospective Charterers must contact Ascente for current pricing and tax obligations


A booking is not confirmed until:

  • A signed charter agreement is received
  • Required deposits are paid
  • Written confirmation is issued by Ascente

5. Itineraries and Navigation

Sample itineraries provided on the website or in marketing materials are for illustrative purposes only.

The itinerary, navigation, and operation of the Vessel during the Charter shall be determined by the Charterer and the captain, crew and service provider engaged by the Charterer.

6. Payment Terms

Specific payment schedules will be outlined in the applicable charter agreement.

Unless otherwise stated:

  • Deposits are non-refundable
  • Final balances must be paid prior to charter commencement
  • Late payments may result in cancellation without refund


Accepted payment methods will be communicated at time of booking.

7. Taxes, Fees, and Duties

Charterers are responsible for all applicable:

  • Sales taxes
  • Value-added taxes
  • Port fees
  • Customs or clearance fees
  • Fuel, provisioning, dockage, and other operating expenses (as defined in the charter agreement)


Rates and tax obligations vary by jurisdiction.

8. Cancellations and Refunds

Cancellation policies are governed exclusively by the applicable AYCA Demise Contract and related agreements.

Website content does not supersede contractual cancellation terms.

9. Guest Conduct

Charterers and guests must:

  • Comply with all laws and regulations
  • Follow vessel rules and safety instructions
  • Treat the vessel, any engaged crew, and equipment with care


Ascente reserves the right to terminate a charter without refund if conduct endangers:

  • Safety
  • Property
  • Compliance with law

 

10. Assumption of Risk

Chartering and maritime activities involve inherent risks, including but not limited to:

  • Weather conditions
  • Sea state
  • Navigation hazards
  • Mechanical failures


By entering into a charter and being aboard the vessel, Charterers and guests voluntarily assume all risks associated with maritime travel.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Ascente shall not be liable for indirect, incidental, consequential, or special damages
  • Ascente is not responsible for personal injury, illness, death, loss, or damage to personal property except as required by law
  • Liability, if any, is limited as outlined in the governing charter agreements

12. Indemnification

You agree to indemnify and hold harmless Ascente, its owners, employees, agents, and affiliates from any claims, losses, damages, or expenses arising from:

  • Your breach of these Terms
  • Your breach of any charter agreement
  • Your actions or omissions

13. Travel Insurance

We strongly recommend that Charterers obtain comprehensive travel insurance, including:

  • Trip cancellation
  • Medical
  • Evacuation
  • Personal liability


Insurance requirements may be specified in the charter agreement.

14. Website Content and Accuracy

While Ascente strives to ensure accuracy, website content may contain errors or omissions.

Ascente reserves the right to:

  • Correct errors
  • Update content
  • Modify offerings without notice


Website content does not form part of any binding agreement.

15. Intellectual Property

All website content, including text, images, logos, videos, and design elements, is owned by Ascente or its licensors and may not be reproduced without written permission.

16. Privacy

Use of this website is also governed by our Privacy Policy, which explains how we collect and use personal information.

17. Third-Party Links

This website may contain links to third-party websites. Ascente is not responsible for their content or privacy practices.

18. Force Majeure

Ascente shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to:

  • Severe weather

19. Governing Law and Jurisdiction

Unless otherwise stated in the applicable charter agreement:

  • Canadian maritime law and the laws of the Province of British Columbia shall govern these Terms
  • Courts located in British Columbia shall have exclusive jurisdiction

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

21. Modifications

Ascente may update these Terms at any time. Continued use of the website constitutes acceptance of updated Terms.
